Donald J. Trump has filed an emergency motion asking a federal judge to pause his own $10 billion defamation lawsuit against the BBC — the one he filed. The goal is to keep the broadcaster from getting its hands on detailed financial records tied to roughly 400 business entities held inside the Donald J. Trump Revocable Trust.
The lawsuit stems from a 2024 Panorama episode titled "Trump, a Second Chance." Last month, Magistrate Judge Enjoliqué Lett ruled that the BBC could obtain those financial documents as part of evaluating Trump's claimed damages, and set a Thursday deadline for the trust to start producing them.
Rather than comply, Trump's team is trying to change the rules of its own lawsuit. The first complaint argued the BBC's edited clip damaged the value of Trump's "brand, properties and businesses" — the claim that gave Lett grounds to order the trust to open its books in the first place.
Now, with the deadline bearing down, Trump's lawyers have quietly filed an amended complaint reframing the damages as purely reputational, arguing that this makes Lett's financial-disclosure order "obsolete." In other words: now that discovery is about to get uncomfortable, the injury was never about the money after all.
Trump's legal team is also arguing that the BBC's real motive is political, and that once the records are released, the damage would be irreversible. Alejandro Brito, head of Trump's legal team, wrote in an appeal to the judge that the BBC is trying to "exploit this litigation," calling its motives politically transparent and accusing the network of turning a narrow defamation claim into a sweeping probe of January 6th, Trump's political activity, and the trust's finances.
There's a wrinkle here worth sitting with: in the filings over just how urgent this "emergency" is, Trump's team has pegged his net worth at $6.5 billion — a notably smaller number than the one he tends to advertise everywhere else.
The New Republic notes that the lawsuit appears to be backfiring on Trump, and suggests that if the motion fails, he may ultimately drop the case entirely.
